Is the 9th Amendment an “odd” clause? IMHO, it is very important. But Judge Bork seems to be unable to find the right to privacy in the Constitution, while IMHO it is found, quite clearly, in the 9th Amendment. OTOH, I seem to be the only one who believes the 9th Amendment is important.
I happened to watching the airing on CSPAN of your book Odd Clauses. I was quiet amazed at your flipant remarks about sections of the constitution that are fundamental to the US and it’s very existence. The senate gives 2 senators for each state as a control (one of the checks and balances). The native born clause, exists to limit access of control of our government by a foreign ententy, additioanlly it ensures contnuity. I am always amazed when I find professors of your ilk teaching in our schools. I am furter amazed that you are actually a lawyer. Sorry you just don’t get it.
If people “got it”, there would not be an XVII Amendment. We should go back to Article I, Section 3.
